R-673-1-86RESOLUTION NO. 673-1-86 (R) A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ESTABLISHING POLICY OF PARTICIPATION AND PAYMENT FOR RECONSTRUCTION FOR PORTIONS OF F.M. 2170 AND STATE HIGHWAY 5. WHEREAS, the City of Allen has by agreement with the State Department of Public Highways and Transportation, assumed the financial responsibility through city bond funds, county bond funds, and assessment procedures for future reconstruction of F.M. 2170 between U.S. 75 and Allen Heights Drive; and, WHEREAS, the State Department of Public Highways and Transportation has by agreement with the City of Allen, assumed the financial responsibility for future reconstruction of State Highway 5 between Chaparral Road and Exchange Parkway; and, WHEREAS, the City Council has stated a desire to remain consistent with total design, landscaping, street lighting, sidewalks, irrigation, and signalization between these two roadways; and, WHEREAS, the City Council is of the opinion that total costs for these improvements may be obtained through assessment at the time of reconstruction of F.M. 2170 between U.S. Highway 75 and Allen Heights Drive; and, WHEREAS, the City Council is of the opinion that landscaping, street lighting, sidewalks, irrigation, and signalization required by City of Allen standards and policies may be in excess of the State of Texas design standards for State Highway 5 between Chaparral Road and Exchange Parkway; and, WHEREAS, the City Council is of the opinion that in order to be consistent with the total reconstruction design of these two roadways, additional funds should be escrowed by the developer of any tract of land along State Highway 5 between Chaparral Road and Exchange Parkway to assure consistent design standards of landscaping, street lighting, sidewalks, irrigation, and signalization; and, WHEREAS, the City Council is of the opinion that policies for funding of these street improvement requirements should be treated differently for the above described portions of F.M. 2170 and State Highway 5. Resolution No. 6 7 3 -1- 8 6 f lf)age 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1. That funds shall not be required to be escrowed for future reconstruction of F.M. 2170 between U.S. 75 and Allen Heights Drive at the time of development, but shall be subject to assessment for such construction in the future. SECTION 2. That any developer developing a tract of land along State Highway 5 between Chaparral Road and Exchange Parkway, shall, prior to development, place cash funds in escrow with the City of Allen for their pro rata share of landscaping, street lighting, sidewalks, irrigation, and signalization, and that the pro rata share per linear foot for any development along either side of State Highway 5 between Chaparral Road and Exchange Parkway is hereby established at forty-five dollars and fourteen cents ($45.14), and such fees shall remain consistent until such time as they may be adjusted by the City Council. SECTION 3. The methods of financing the reconstruction of these roadways described in Sections 1 and 2 are hereby declared city policies by the City Council of the City of Allen, Collin County, Texas.
