A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, FINDING THAT A GUN & ACCESSORY
SHOP IS A NEW AND UNLISTED USE; DECLARING THE APPRO-
PRIATE DISTRICTS FOR SUCH USE, AND DEFINING SUCH USE IN
THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF ALLEN.
WHEREAS, The City of Allen has been requested to interpret whether a
"Gun and Accessory Shop" is a new and unlisted use within the Definitions and
Schedule of Uses of the City's Comprehensive Zoning Ordinance; and,
WHEREAS, Section 2.08 of the Comprehensive Zoning Ordinance of the City
of Allen delineates the appropriate procedures regarding new and unlisted uses;
and,
WHEREAS, the Planning and Zoning Commission in following these proced-
ures, finds that a "Gun and Accessory Shop" is a new and unlisted use and has
recommending that the City Council declare Shopping Center Districts as being
the appropriate zoning districts for this use; and,
WHEREAS, the Planning and Zoning Commission has recommended that the
City Council provide a definition in the Comprehensive Zoning Ordinance for this
use;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ALLEN, TEXAS:
SECTION 1: For purposes of interpretation and finding, the term "Gun and
Accessory Shop" shall have the following definition:
"Gun and Accessory Shop" - an establishment that is primarily engaged
in the sale of new guns and accessories. The majority of all sales
must consist of new merchandise. The establishment cannot loan
money to - the general public on any merchandise, nor can such
merchandise be held as collateral by the establishment for any pur-
pose, as is practiced in a pawn shop.
SECTION 2: The City Council of the City of Allen finds that a Gun and
Accessory Shop is a new and unlisted use, and should be included in the Com-
prehensive Zoning Ordinance.
SECTION 3: The City Council declares that this use shall be allowed by
right in the following districts: "SC" Shopping Center.
