R-868-8-88RESOLUTION NO. 868-8-88 (R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, STATING THAT FOR THE PURPOSE OF THE TELEPHONE EXTENDED AREA SERVICE BALLOTING PROCESS, THE CITY SECRETARY WILL BE CONSIDERED TO BE UNDER THE DIRECTION OF THE CITY MANAGER'S OFFICE. WHEREAS, since 1985 the City Council has directed an intensive effort toward obtaining telephone extended area service (EAS); and, WHEREAS, the Public Utility Commission did rule in its final order dated July 22, 1988 in favor of the City's request and directing that the City conduct a balloting process to determine if the subscribers in the 727 ex- change desire EAS; and, WHEREAS, the final order requires that a balloting procedure must be implemented and further states that the balloting procedure shall be per- formed by City employees under the direction of the City Manager's Office; and, WHEREAS, the City Council finds it desirable and necessary that the City Secretary because of her knowledge and expertise in the area of con- ducting elections, be closely involved with the balloting process; and, WHEREAS, Section 3.08 of the Allen City Charter designates the City Secretary as a staff level position to be appointed by the City Council and not considered a part of the administrative services of the City; and, WHEREAS, the Council is desirous of meeting the mandates of the City Charter and the final order of the Public Utility Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. For the purpose of the conducting of the balloting procedure for determining if the community will have EAS, the City Secretary shall be considered to be performing under the direction of the City Manager's Office. This shall apply solely and singularly to the EAS balloting process and is not intended to apply to any other thing. SECTION 2. A copy of this resolution will be maintained by the City and a copy made available to any of the parties to Docket No. 6568 of the Public Utility Commission of Texas if they so request.
