R-895-12-88RESOLUTION NO. 895-12-88(R) A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, STATING THE COUN- CIL'S POSITION REGARDING THE TAX ROLLBACK ELEC- TION TO BE HELD ON FEBRUARY 4, 1989, DECLARING CERTAIN FACTS RELATED TO THE TAX ROLLBACK ISSUE AND STATING THAT THE CITY WILL RESPOND TO RE- QUESTS BY PROVIDING FACTUAL AND COMPLETE INFOR- MATION RELATED TO THE TAX ROLLBACK ELECTION. WHEREAS, the Allen City Council began its annual program budget review process with a workshop on June 30, 1988, prior to the submission of the City Manager's Budget on July 29, 1988. The Council budget review process included a series of workshop meetings held August 11 through August 14, public hearings on the budget and the tax rate held on August 25 and September 6 respectively, and a final public meeting held on September 15 when the program, budget and tax rate were adopted; and, WHEREAS, to support the programs ennumerated in the budget, the Council adopted a tax rate of 590 per $100 valuation; and, WHEREAS, in accordance with the guidelines published by the Texas State Property Tax Board the approved tax rate constitutes an effective tax rate increase of 9.6%; and, WHEREAS, State law allows a tax rollback election to be held if the tax rate increase is greater than 8% and a validated petition containing at least 10% of the registered voters within the jurisdiction is submitted; and, WHEREAS, on December 8, 1988, petitions were filed with the City containing signatures of more than 10% of the registered voters within the City, therefore causing a tax rollback election to be called; and, WHEREAS, if the tax rollback were approved the tax rate would be reduced from 59� to 57.845$ per $100 valuation and would represent a savings of $9.82 per year to a residential homeowner on property valued at $85, 000; and, WHEREAS, if the tax rollback were approved, a revenue reduction of $100,401 in the maintenance and operations budget of the City would result; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: RESOLUTION NO. R A S -1 2- R R (R) Page 2 SECTION 1. The City Council finds the above information to be true and correct. SECTION 2. The City Council, in consideration of the tax rollback petition has reevaluated the programs for which the tax rate was set exceed- ing the 8% limit and as a result of that reevaluation, the City Council reaffirms the importance that the programs represent for the community. SECTION 3. The City Council embraces the concept that the will of the people should provide direction to the City Council regarding any and all matters of vital importance to the community. SECTION 4. The City Council will respond to all requests by providing factual and complete information related to issues inherent in the tax rollback election.
