R-1138-10-92RESOLUTION NO. 1138-10-92(R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, FINDING THAT A DAY CARE FOR DISABLED AND/OR ELDERLY IS A NEW AND UNLISTED USE AND DECLARING THE APPROPRIATE DISTRICTS FOR SUCH USE. WHEREAS, the City of Allen has been requested to interpret whether a "Day Care for Disabled and/or Elderly is a new and unlisted use within the definitions and schedule of uses of the City's Comprehensive Zoning Ordinance; and, WHEREAS, Section 2.08 of the Comprehensive Zoning Ordinance of the City of Allen delineates the appropriate procedure regarding new and unlisted uses; and, WHEREAS, the Planning and Zoning Commission in following those procedures, finds that a Day Care for Disabled and/or Elderly is a new and unlisted use and is recommending that the City Council declare the appropriate districts for this use. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: For purposes of interpretation and finding, the term "Day Care for Disabled and/or Elderly" shall have the following meaning: "A facility arranged and conducted for the organized care of the disabled and/or elderly on a daytime basis with no overnight care . " SECTION 2: The Allen Planning and Zoning Commission and City Council agree that this is a new and unlisted use. SECTION 3: The City Council finds this use shall be allowed by right in the following districts: "LR" Local Retail, "SC" Shopping Center, "LC" Light Commercial, "GB" General Business, "PD" Planned Development; and by Specific Use Permit in "MF -1 MF -2 and MF -3" Multi -family, "MH" Mobile Home Park, "GO" Garden Office, "O" Office, "CC" Corridor Commercial, "LI" Light Industrial, "GI" General Industrial, and "CBD" Central Business District.
