A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, CREATING A POLICY AND ESTABLISHING
GUIDELINES FOR THE SETTLEMENT OF SMALL CLAIMS AGAINST THE
CITY OF ALLEN FOR PERSONAL INJURY OR PROPERTY DAMAGE AND
AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH SETTLEMENTS ON
BEHALF OF THE CITY OF ALLEN.
WHEREAS, the City of Allen periodically has small claims made against
it for property damage or personal injury; and.
WHEREAS, the absence of a policy often encourages a claimant to seek
legal action; and,
WHEREAS, all insurance coverage for the City of Allen contains a
deductible; and,
WHEREAS, small claims could often be settled without the use of
litigation and in the best interest of the City of Allen.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, COLLIN COUNTY, TEXAS THAT:
SECTION 1: A policy is hereby created which authorizes the City
Manager to act on behalf of the City of Allen in the settlement of
small claims against the City of Allen and authorizes him to execute
any documents associated with the claim and consistent with the
sections of this resolution.
SECTION 2: Settlement will be made only on bonified property damage
or personal injury claims. No claims will be settled on the basis of
mental anguish or any other undocumented claim.
SECTION 3: Claims for property damage or personal injury shall be
made to the City of Allen in accordance with Section 10.08 of the City
Charter of the City of Allen.
SECTION 4: The City Attorney or his representative shall review all
forms and releases and make a recommendation to the City Manager prior
to the execution of the same.
SECTION 5: The settlement of claims shall not exceed $500.00 for
property damage or $1000.00 for personal injury.
