A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AUTHORIZING THE TAX ASSESSOR/COLLECTOR TO
RESELL PROPERTY OWNED BY THE CITY OF ALLEN FOR CONSIDERATION
OF LESS THAN TOTAL TAXES OWED.
WHEREAS, the City of Allen has numerous properties standing in the name of AISD, City of Allen, and
Collin County, acquired by tax sale pursuant to Chapter 34 of the Texas Property Tax Code; and,
WHEREAS, the City of Allen desires to dispose of the properties, or their interest in the properties; and,
WHEREAS, there may be outstanding taxes due and payable to the City of Allen on these properties; and,
WHEREAS, there may be outstanding taxes due and payable on these properties to other taxing jurisdictions;
and,
WHEREAS, the City of Allen is of the opinion that other taxing jurisdictions would be willing to enter into
an agreement with them for disposal of these properties; and,
WHEREAS, with consent of each taxing jurisdiction entitled to receive proceeds from the sale of these
properties, an amount less than the total owed for taxes could be received for the sale of the properties; and,
WHEREAS, no taxes or revenues are being generated by the properties for any of the taxing jurisdictions
as long as the properties are owned by the City of Allen and other taxing jurisdictions;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS THAT:
SECTION 1: After attempting to sell property pursuant to Section 34.01 of the Property Tax Code, any
and all property qualifying for the resale provisions of Section 34.05 of the Property Tax Code are hereby
assigned to the AISD/City of Allen Tax Assessor/Collector for immediate disposal. The Tax Asses-
sor/Collector shall determine the minimum bid, if any, to be required at the time of sale.
SECTION 2: The City Manager of the City of Allen is empowered to execute all deeds or other
documents necessary and/or convenient to effectuate the sale of the property pursuant to the provisions of
Section 34.05 of the Property Tax Code.
SECTION 3: The Tax Assessor/Collector for the City of Allen/AISD is hereby authorized and directed
to enter into an agreement with other taxing jurisdictions, wherein all property in the name of any of the
jurisdictions shall be disposed of. Said agreement to call for disposal of property at whatever price required
to actually dispose of the property, with the actual proceeds being disbursed according to Section 34.06 of
the Property Tax Code:
(a) All cost and expense of court;
(b) All cost and expense of sale;
(c) The balance of proceeds to each taxing jurisdiction as provided by Section 34.02 of the
Property Tax Code.
SECTION 4: The City of Allen is desirous of disposing of these properties at any price in order to
generate the future revenue which will be forthcoming from the property being placed back on the tax rolls.
As stated above, the proceeds from the sale are to be disbursed as provided by Section 3 above.
SECTION 5: The City Council of the City of Allen directs that this Resolution and the Agreement
attached hereto be in multiple parts and that a signed original Agreement be delivered immediately with copies
of the Resolution to all other taxing jurisdictions for their acceptance.
SECTION 6: The City Manager of the City of Allen and the Tax Assessor/Collector are authorized and
directed to do any and all things necessary and proper in connection with this Resolution.
