A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, COMMITTING TO PROVIDE REQUIRED FUNDING FOR THE
DEVELOPMENT AND CONSTRUCTION OF THE EXCHANGE PARKWAY
PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH THE TEXAS DEPARTMENT OF TRANSPORTATION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the State and the City desire improvements to Exchange Parkway from U.S. 75 to S.H. 5, to
be hereinafter identified as the "Project"; and,
WHEREAS, the Intermodal Surface Transportation Efficiency Act of 1991, ("ISTEA") codified under Title
23 U.S.C. Section 120 establishes that the Federal share of funding for Surface Transportation Programs for
urbanized areas will not exceed eighty percent (80%) of the Project cost; and,
WHEREAS, the City has offered to participate in the development and construction of the Project;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS THAT:
SECTION 1: The City will provide required funding, prepare the preliminary engineering and design
plans, acquire the necessary right-of-way, provide relocation assistance, prepare right-of-way description and
value determination, accomplish the adjustment of utilities, condemn property, provide certifications,
providing environmental mitigation, and provide other necessary items as required by the State.
SECTION 2: The City will submit a check or warrant made payable to the "Texas Department of
Transportation" in the amount of $9,100.00, upon execution of the construction agreement between the State
and the City.
SECTION 3: The City will submit a check or warrant made payable to the "Texas Department of
Transportation" in the amount specified by the State equal to twenty percent (20%) of the total estimated
construction cost as stated in the construction agreement. The estimated construction cost payable by the City
is twenty percent (20%) of $4,298.750.00, which equals $859,750.00. The payment will be made within
thirty (30) days of receipt of the State's written notification, which will be sent sixty (60) days prior to the
date set by the State for receipt of the construction bids.
SECTION 4: In the event of additional funding is required by the City at anytime during the
develep.aert of the Project, the City will provide the funds within thirty (30) days from receipt of the State's
written notification.
