A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS,
AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTY FOR PUBLIC
PURPOSES FOR USE BY THE CITY OF ALLEN, TEXAS, SEPARATELY, OR FOR
USE BY THE CITY OF ALLEN, TEXAS, AND THE CITY OF FRISCO, TEXAS,
JOINTLY.
WHEREAS, both the City of Allen, Texas, and the City of Frisco, Texas, are jointly
and severally desirous of acquiring private real property for use in the development and
expansion of their public water supply systems, including the construction of water storage
facilities; and,
WHEREAS, the City of Allen, Texas, is interested in acquiring private real property
for use in the location, construction and operation of police and/or fire training facilities;
and,
WHEREAS, the Home Rule Charter of the City of Allen, Texas, as well as Chapters
251, 273, and 402 of the Local Government Code, Vernon's Texas Codes Annotated,
authorize the acquisition of private real property, either separately or jointly with another
municipality, by gift, dedication, or purchase, with or without condemnation; and,
WHEREAS, the City Council of the City of Allen, Texas, has determined that the
property which it is desirous of acquiring for the above -stated public purposes must be
located within Collin County, Texas, as required by Section 273.001 of the Local
Government Code, V.T.C.A.;and,
WHEREAS, the City Council of the City of Allen, Texas, has determined that the
proposed uses of the private real property which it desires to acquire are lawful public
purposes as established by the Home Rule City Charter of the City of Allen, Texas, and/or
Chapters 251, 273, and 402 of the Local Government Code, V.T.C.A.;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ALLEN, TEXAS, THAT:
1. The City Manager of the City of Allen, Texas, is hereby authorized to locate
and negotiate with the owner(s) of an appropriate amount of real property located in Collin
County, Texas, which will permit the City of Allen to accomplish the above -stated goals.
2. As a part of the negotiations, the City Manager of the City of Allen, Texas,
is authorized to consider acquisition of said property(ies) by gift, dedication, purchase, or
otherwise.
3. The City Manager of the City of Allen, Texas, is hereby authorized to employ
real property appraisers as he may deem necessary to assist him in determining the fair
market value of said real property(ies).
4. The City Manager of the City of Allen, Texas, is hereby authorized to employ
legal counsel as he may deem necessary to assist him in his negotiation and/or contract for
the acquisition of said property(ies).
5. As a part of the negotiations for the acquisition of said property(ies), the City
Manager of the City of Allen, Texas, is authorized to enter into a written contract(s) with
the owner(s) of the property(ies), subject to final approval thereof by the City Council of
the City of Allen, Texas, as required by law.
6. The City Manager of the City of Allen, Texas, is hereby authorized to
negotiate with appropriate representatives of the City of Frisco, Texas, for the terms and
provisions of an Interlocal Agreement between the City of Allen, Texas, and the City of
Frisco, Texas, with regard to the City of Frisco's ultimate purchase and use of a portion of
the property(ies) which is/are the subject of this Resolution, subject to final approval by the
City Council of the City of Allen, Texas, as well as the City Council of the City of Frisco,
Texas.
