A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN
INTERLOCAL AGREEMENT BY AND BETWEEN THE CITY OF ALLEN, TEXAS
AND THE TOWN OF FLOWER MOUND, TEXAS PROVIDING FOR A
COOPERATIVE PURCHASING PROGRAM FOR GOODS AND SERVICES; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council has been presented a proposed interlocal agreement by and between the City
of Allen and the Town of Flower Mound establishing a Cooperating Purchasing Program, a copy of which is
attached hereto as Exhibit "A" and incorporated herein by reference (hereinafter called "Agreement"); and,
WHEREAS, upon full review and consideration of the Agreement and all matters attendant and related thereto,
the City Council is of the opinion that the terms and conditions thereof should be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS THAT:
SECTION 1: The terms and conditions of the Agreement having been reviewed by the City Council of the
City of Allen and found to be acceptable and in the best interest of the City of Allen and its citizens, are hereby
in all things approved.
SECTION 2: This Resolution shall become effective immediately upon its passage.

INTERLOCAL AGREEMENT

WHEREAS, the Town of Flower Mound and the City of Allen want to enter into an
agreement to permit the Town of Flower Mound to utilize the City of Allen's computer
vendor, for purchases of police computer.equipment and software; and
WHEREAS, S 791.025, Texas Government Code, provides authorization for political
subdivisions to enter into contracts with local governments. _
Now, THEREFORE, THIS MEMORANDUM OF AGREEMENT is hereby made and
entered into by the Town of Flower Mound and the City of Allen upon and for the mutual
consideration stated herein:
WITNESETH:
I.
Town of Flower Mound agrees to purchase police computer equipment and software from
the City of Allen's Request for Proposal No. 950825.
II.
Town of Flower Mound will process all orders and payments direct with various vendors.
Town of Flower Mound agrees it will not sue or cause a suit to be filed against the City
of Allen based on any liability or damages the Town of Flower Mound may suffer as a
result of claims, demands, costs, or judgments against the work and services under this
Agreement, or arising from accident, injury , or damage, whatsoever, to any person, or
persons, or to the property of any person(s) occurring during the performance of this
Agreement, except for any liability or damages caused by the negligence of the City of
Allen, its agents, officers, and/or employees.
IV.
The Mayor is authorized to enter into this Interlocal, Agreement for the Town of Flower
Mound. It is agreed by the Town of Flower Mound and the City of Allen that no
purchases will commence hereunder until this Interlocal Agreement has been fully
executed by the parties hereto.

This Interlocal Agreement may not be assigned and embodies the entire agreement
between the parties, and may not be amended except in writing.
