R-3368-3-16RESOLUTION NO. 3368-3-16(R) ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, DETERMINING THE PUBLIC NECESSITY EXISTS AND FINDING A PUBLIC PURPOSE FOR THE ACQUISITION OF LAND FOR A RIGHT-OF-WAY AND ALL ATTACHED IMPROVEMENTS FOR INTERSECTION IMPROVEMENTS FOR MCDERMOTT DRIVE AT US75, STACY ROAD AT US75, AND GREENVILLE AVENUE AT EXCHANGE PARKWAY AS DESCRIBED IN THE EXHIBITS ATTACHED HERETO, WITHIN THE CITY OF ALLEN, COLLIN COUNTY, TEXAS; PROVIDING FOR A LAST AND FINAL OFFER AND AUTHORIZATION TO PURCHASE SAID RIGHT-OF-WAY AND EASEMENTS FOR JUST COMPENSATION AND, IF SUCH OFFER IS REFUSED, AUTHORIZING THE CITY ATTORNEY TO FILE PROCEEDINGS IN EMINENT DOMAIN TO ACQUIRE THE RIGHT-OF-WAY; RATIFYING PRIOR ACTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, McDermott Drive, Stacy Road, Greenville Avenue, Exchange Parkway, and US 75 are major thoroughfares identified on the adopted Thoroughfare Plan, and, WHEREAS, the City Council for the City of Allen finds that a public need exists to acquire the necessary right-of-way to facilitate the construction of Intersection Improvements at McDermott Drive at US75, Stacy Road at US75, and Greenville Avenue at Exchange Parkway, and, WHEREAS, it is hereby determined that there is a public necessity, and that a public use and purpose for the welfare and convenience of the citizens requires the acquisition of title to land and improvements vesting in the City, for the public purpose of use in completing the Intersection Improvements at McDermott Drive at US75, Stacy Road at US75, and Greenville Avenue at Exchange Parkway, and WHEREAS, the City Council desires for the City Manager or his designee to take the necessary steps to negotiate the purchase the property interests needed for the Intersection Improvements, and WHEREAS, the City Council recognizes that despite the most earnest of intentions to reach an agreement on the transaction of land, in some cases an agreement cannot be reached and other legal means must be employed to secure the property rights to make necessary improvements for the public welfare, and WHEREAS, in the event the negotiations for the purchase of the necessary Property Interests are unsuccessful, the City Council of the City of Allen, Collin County, Texas finds it to be in the public interest and to the benefit of the health, safety, and welfare of its citizens to authorize the use of the power of eminent domain to acquire the necessary interests in real property to construct Intersection Improvements at McDermott Drive at US75, Stacy Road at US75, and Greenville Avenue at Exchange Parkway. NOW, THEREFORE, BE IT RESOLVED BY THIN CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The facts and recitations contained in the above preamble of this Resolution are found to be ' [me and correct and are hereby incorporated herein for all purposes. SECTION 2. The City Council of the City of Allen, Texas, hereby finds and determines that a public necessity exists for the welfare of the City and its citizens and it is in the public interest to acquire right-of- way (or fee simple title, if necessary) and all attached improvements for the construction of Intersection Improvements at (1) McDermott Drive at US75, specifically 559 square feet of land, more or less, in the William Perrin Survey, Abstract No. 708, City of Allen, Collin County, Texas, owned by Jennifer Dawn Weidner and Ryan Lee Weidner, and 300 square feet of land, more or less, in the William Perrin Survey, Abstract No. 708, City of Allen, Collin County, Texas, owned by 7 -Eleven Inc., and being a portion of Lot 4R, Block 8 of the Exxon McDermott Addition; (2) Stacy Road at US75, specifically 11,254 square feet of land, more or less, in the H. Westsel Survey, Abstract No. 1026, City of Allen, Collin County, Texas owned by Nimbus Partners, LP; and (3) Greenville Avenue at Exchange Parkway, specifically 1497 square feet of land, more or less, in the Lewis Wetsel Survey, Abstract No. 978, City of Allen, Collin County, Texas, owned by Allen-Bablyon LLC, and being a portion of Lot 1, Block A. of the Exchange Parkway Village, and 491 square feet of land, more or less, in the Lewis Weisel Survey, Abstract No. 978, City of Allen, Collin County, Texas owned by FAEC Holdings 382123, LLC, and being a portion of Lot 2, Block A of the Exchange Parkway Village, as more fully described in the exhibits attached hereto, and made a part hereof for all purposes. SECTION 3. The City Manager or designee is hereby authorized on behalf of the City to acquire the necessary rightof-way and all attached improvements for the construction of the aforesaid intersections and, if necessary, to attempt to agree on damages and compensation to be paid to the owners of the property in an amount which is not less than the fair market value of interest in the respective properties to be acquired, including damages to the remainder, if any, said offer being an amount which is not less than the amount set forth in the independent appraisal of the interest in the respective property obtained by the City and provided to said property owners. In the event such offer is accepted, the City Manager or designee is hereby authorized to negotiate and sign such contracts and other documents the City Manager determines to be reasonable and necessary in order to close on the purchase of the above described public street and general utility easement If the City Manager or designee is unable to acquire the necessary right-of-way and attached improvements, or determines that an agreement as to damages and compensation cannot be reached then the City Manager or designee is authorized to snake a last and final offer of just and adequate compensation to the owners of the properties. B the last and final offer is not accepted the City Attorney or designee is hereby authorized to file or cause to be filed against the owners and interested parties of the properties, proceedings in eminent domain to acquire such right-of-way or fee simple title as appropriate. To the extent any of the foregoing actions have been taken by the City Manager and/or City Attorney prior to adoption of this Resolution, such acts are hereby ratified and approved. SECTION 4. If it is later determined that there are any errors in the descriptions contained herein or if later surveys contain more accurate revised descriptions, the City Attorney or designee is authorized to have such errors corrected or revisions made without the necessity of obtaining City Council approval authorizing the condemnation of the corrected or revised property. SECTION 5. This resolution shall become effective immediately from and after its passage.
