O-3300-5-15ORDINANCE NO. 3300-5-15 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING ORDINANCE NO. 3150-5-13 MAKING A NON. SUBSTANTIVE CHANGE TO THE DESIGNATION OF THE SPECIFIC USE PERMIT NUMBER ESTABLISHED THEREIN FROM NUMBER 134 TO NUMBER 143 TO PREVENT DUPLICATE NUMBERING; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. 1 WHEREAS, the City Council adopted Ordinance No. 3142-2-13 on February 26, 2013, granting a specific use permit for a gymnastics and sports training facility for a portion of Tract G & H, Allen Business Centre, City of Allen, Collin County, Texas (also known as 21 Prestige Circle, Allen, Texas) which was designated as "Specific Use Permit No. 134"; and, WHEREAS, the City Council adopted Ordinance No. 3150-5-13 on May 14, 2013, granting a specific use permit for a fitness and health center use for Lot 1, East Main Place, City of Allen, Texas (also known as 803 E. Main Street, Suite C, Allen, Texas), which was erroneously also designated as `Specific Use Permit No. 134'; and, WHEREAS, in order to eliminate any confusion in the administration and enforcement of the City's zoning regulations relating to the development and use of the above-described properties, the City Council finds it to be in public interest to correct the specific use permit designation set forth in Ordinance No. 3150-5-13; and, WHEREAS, the proposed action is solely to correct an error resulting in a duplication of numbering of specific use permits and does not amend any zoning regulations affecting the property described in Ordinance No. 3150-5-13. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. Ordinance No. 3150-5-13 is amended by changing the phrase `Specific Use Permit No. 134" wherever it appears in the caption and Section l of said ordinance to read `Specific Use Permit No. 143." SECTION 2. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this Ordinance, or of the Allen Land Development Code Zoning Regulations, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Allen Land Development Code Zoning Regulations, as amended hereby, which shall remain in full force and effect. SECTION 3. This Ordinance shall take effect immediately from and after its passage.
