' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, CANCELING THE ELECTION SCHEDULED TO BE HELD
MAY 12, 2012, FOR THE PURPOSE OF ELECTING THE CITY COUNCILMEMBER
FOR PLACE NO. 1, 3 AND 5; DECLARING EACH UNOPPOSED CANDIDATE
ELECTED TO OFFICE; ORDERING THE POSTING OF THIS ORDINANCE AT CITY
HALL AND AT THE MUNICIPAL COURT AND PARKS ADMINISTRATION
BUILDING POLLING PLACE ON ELECTION DAY; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, Resolution No. 3068-2-12(R), was adopted by the City Council on February 28, 2012, for the
purpose of electing the City Councilmember for Place No. 1, 3 and 5 to the Allen City Council; and,
WHEREAS, the election is for officers of the City in which write-in votes may be counted only for names
appearing on a list of write-in candidates and in which each candidate whose name is to appear on the ballot is
unopposed, and no proposition is to appear on the ballot; and,
WHEREAS, the filing deadlines for time placement on the ballot and declaration of write-in candidacy have
passed; and,
WHEREAS, the City Council has received the City Secretary's written certification that each candidate is
unopposed for the election; and,
' WHEREAS, in these circumstances, Section 2.053(a)ofthe Texas Election Code authorizes the governing body
to declare each unopposed candidate elected to office and to cancel the election thereby avoiding the expenses
related to holding an election and saving public funds.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The general election for the purpose of electing the City Councilmember Place No. 1, 3 and 5
previously called for May 12, 2012, is hereby canceled.
SECTION 2. The following candidates, whom unopposed for the May 12, 2012, General Election, are hereby
declared elected to office and shall be issued a certificate -of -election:
Councilmember Place No. 1 Kurt Kizer
Councilmember Place No. 3 Joey Herald
Councilmember Place No. 5 Gary Caplinger
SECTION 3. The City Secretary shall post a copy of this ordinance at City Hall and on Election Day shall post a
copy of this ordinance at the polling place located at the Municipal Court and Parks Administration building, 301
Century Parkway, Allen, Texas.
SECTION 4. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance or
' of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall
not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby,
which shall remain in full force and effect..
SECTION & This ordinance shall take effect immediately in accordance with the provisions of the Charter of
the City of Allen, and it is accordingly so ordained.

PROGRAMADAS PARA EL 12 DE MAYO DE 2012, PARA EL PROP6SITO DE
ELEGIR AL CONCEJAL PARA LOS LUGARES NOMERO 1, 3 Y 5; DECLARANDO
QUE CADA CANDIDATO QUE ESTA SIN OPOSIC16N TOME POSES16N DE SU
CARGO; ORDENANDO QUE ESTA ORDENANZA EST#, FIJADA EN EL
AYUNTAMIENTO Y EN EL CENTRO ELECTORAL DE ALLEN MUNICIPAL
CORTEJA FACILIDAD EL DfA ELECTORAL; PROPORCIONANDO UNA
CLAUSULA DE DIVISIBILIDAD; Y DECLARANDO UNA FECHA EFECTIVA.
CONSIDERANDOQUE, la Resoluci6n N6mero 3068-2-12(R), foe aprobada porel Concejo Municipal el 28
de febrero de 2012, para el prop6sito de elegir al Concejal pam el Lugar N6mero 1, 3 y 5 al Concejo Municipal de
Allen; y
CONSIDERANDO QUE, las elecciones son para los oficiales de la Ciudad en las cuales las votaciones escritas
per mano estarSn contadas solo para los nombres que aparecen on una lista de candidates que se puede ahadir a la
boleta per mano y en las cuales cada candidate cuyo nombre aparecerfi en Is boleta esn5 sin oposici6n y ninguna
proposici6n aparecenk en la boleta; y,
CONSIDERANDO QUE, los plazos de entregar on nombre Pam estar en la boleta de votaci6n y para la
declamci6n de una candidamm que los votantes escribir'un en la boleta per mano han pasado; y,
t CONSIDERANDO QUE, el Concejo Municipal ha recibido Is certificaci6n escrita del Secretario Municipal
que cada candidate est4 sin oposici6n para las elecciones; y,
CONSIDERANDO QUE, en estas c rcunstancias, la Secci6n 2.053(a) del C6digo Electoral de Texas autoriza
que el cuerpo gobemante declare que cada candidate sin oposici6n tome posesi6n de so cargo y que cancele las
elecciones asi evitando los gastos relacionados a celebrar unas elecciones y ahorrando los fondos p6blicos.
AHORA, POR LO TANTO, ESTA ORDENADO POR EL CONCEJO MUNICIPAL DE LA CIUDAD DE
ALLEN, CONDADO DE COLLIN, TEXAS, QUE:
SECC16N 1. Las elecciones genemles para el prop6sito de elegir al Concejal Los Lugares N6mero 1, 3 y 5
anteriormente convocadas per el 12 de mayo de 2012, estan canceladas per el presente.
SECC16N 2. Los siguientes candidates, quienes estin sin oposici6n para las Elecciones Generales del 12 de
mayo de 2012, per el presente estSn elegidos a sus cargos y recibir5n on certificado de elecci6n:

SECCON 3. EI Secretario Municipal fijarA una Copia de este ordenanza on el Ayuntamiento y el Dia Electoral
fijara una copia de esta ordenanza en el centro electoral ubicado en Allen Municipal Corteja Facilidad, 301 Century
' Parkway, Allen, Texas.
SECCI6N 4. Debe cualquier palabra, frase, plrrafo, Subdivisi6n, clAusula, £rase o Secci6n de esta ordenanza o
c6digo de ordenanzas, enmendada per Is presente, se adjudic6 o declarada nula o inconstitucional, la misma no
afectar4 la validez de las restantes partes de dicha ordenanza o c6digo de ordenanzas, que permanecera en pleno
vigor y efecto, modificada por In presente.
' SECC16N 5. Esta ordenanza surtir4 efecto inmediatamente despu6s de su apmbaci6n y publicaci6n conforme a
las provisiones del Fuem de In Ciudad de Allen, y por consiguiente est4 decretada.
