O-3018-6-11ORDINANCE NO. 3015-6.11 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE ZONING REGULATIONS, AND ZONING MAP, AS PREVIOUSLY AMENDED, BY CHANGING THE ZONING OF 27328± ACRES OUT OF THE HENRY WETSEL SURVEY, ABSTRACT NO. 1026, COLLIN COUNTY, TEXAS, DESCRIBED IN EXHIBIT ,A," ATTACHED HERETO FROM COMMUNITY FACILITIES 11CF" AND SHOPPING CENTER 11SC', TO PLANNED DEVELOPMENT "PD" NO. 107 FOR A CHURCH; ADOPTING DEVELOPMENT REGULATIONS; ADOPTING A CONCEPT PLAN; ADOPTING BUILDING ELEVATIONS; ADOPTING A SIGN PLAN; ADOPTING A SCREENING PLAN; PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Allen, Texas, in compliance with the laws of the State of Texas and the Ordinances of the City of Allen, Texas, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all the property owners generally and to all persons interested and situated in the affected area, and in the vicinity thereof, and in the exercise of its legislative discretion, the City Council has concluded that the Allen ' Land Development Code Zoning Regulations and Zoning Map of the City of Allen, Texas, as previously amended, should be further amended as follows: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The Allen Land Development Code Zoning Regulations and Zoning Map of the City of Allen, Texas, as amended by changing the zoning of 27.328± acres of land out of the Henry Weisel Survey, Abstract No. 1026, City of Allen, Collin County, Texas, and being further described in Exhibit "A," attached hereto, and incorporated herein by reference (`the Property") from Community Facilities "CF' and Shopping Center "SC' Districts, to "PD" Planned Development No. 107. SECTION 2. The Property shall be developed and used only in accordance with the Development Regulations set forth below: A. General Purpose: The purpose of this zoning district is for the use and development of the Property as a church with a worship center and related educational and support facilities subject to the development standards and regulations set forth in this Ordinance. B. Base Zoning District: The Property shall be developed and used only in accordance with Community Facilities "CF' Zoning District regulations except as otherwise modified and provided by this Ordinance. ' C. Concept Plan: The Property shall be developed and used only in accordance with the Concept Plan attached hereto as Exhibit "B," and incorporated herein by reference. D. Building Elevations: The Property shall be developed and used only in accordance with the Building Elevations attached hereto as Exhibit "C' and incorporated herein by reference. E. Sign Plan: The Property shall be developed and used only in accordance with the Sign Plan ' attached hereto as Exhibit "D" and incorporated herein by reference. F. Perimeter Screening Plan: The Property shall be developed and used only in accordance with the Perimeter Screening Plan attached hereto as Exhibit "E" and incorporated herein by reference. G. Buildine Height: The maximum height of any building constructed n the Property shall be thirty-five (35) feet; provided, however, the main church building housing the worship center and the bell tower as each are shown on Exhibit "B" may exceed 35 feet in height at a ratio of one (1) additional foot in height for each additional foot added to the width and depth of front, side and rear yard building setback. H. Landscace Buffers: The area of the landscape setback within fifty feet to either side of the centerline of future driveway connections to State Highway 5 (Greenville Avenue) or Trinity Drive shall contain no more than 50%u turf. 1. Existing Screening: Perimeter screening existing on the effective date of this Ordinance consisting of an eight -foot tall decorative metal fence, with a black powder -coated finish and a pattern of low shrubs interspersed with groupings of taller trees are planted along the entire length of the steel fence, on the interior side shall be maintained. If any of the low shrubs die or are otherwise removed, they will be replaced with full size evergreen plant material, such as large shrubs or small ornamental trees in order to provide for a solid screen. I Additional Screening: Perimeter screening shall be erected and maintained along the property lines between SL Jude Catholic Parish and the neighboring Spring Meadow residential development, consisting of an eight -foot tall wrought iron metal fence, with a black powder -coated finish. In addition, a pattern of large evergreen shrubs interspersed with groupings of taller evergreen trees shall be planted along the entire length of the wrought iron fence, on the interior side, in order to provide for a solid screen, in accordance with the perimeter screening concept attached as Exhibit "E" and the Plant Plan attached hereto as Exhibit "F'. Such additional screening shall be constructed and in place prior to the issuance of a certificate of occupancy for any building or other structure constructed on the Property after the effective date of this Ordinance and prior to commencement of use of any athletic fields adjacent to the area where such additional screening is to be installed. IL Signage: Monument signage and building signage shall be designed and constructed in conformance with the architectural renderings set forth in Exhibit "D". The existing sign ("Spring Meadow" subdivision sign) at the northwest comer of State Highway 5 (Greenville Avenue) and Trinity Drive shall not be improved or modified in any way for the use of Spring Meadow. The sign may only be improved or modified exclusively for the use of St. Jude Catholic Parish and shall be subject to the review and approval of the Director of Planning and Development. L. Accessory Building: The existing accessory buildings shall be landscaped and maintained in order to provide an effective foundation screening along the structure perimeters. M. Detention Ameniflution: The existing detention facility and any future detention facility shall be amenitized per the standards set forth in the Allen Land Development Code. N. Playfields. Outbuildings and Grandstands: Unlighted playfields shall be considered an accessory use not requiring a specific use permit. Grandstands and minor outbuildings (i.e. Ordinance No. 3018-611, Page 2 I concession stands) shall require a Specific Use Permit (SUP) application and review. No lighting for outdoor playfields shall be installed on the Property until approved by the City Council. SECTION 3. In the event of an irreconcilable conflict between the provisions of another previously adopted ordinance of the City of Allen and the provisions of this Ordinance as applicable to the use and development of the Property, the provisions of this Ordinance shall be controlling. SECTION 4. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this Ordinance, or of the Allen Land Development Code, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said Ordinance or the Allen Land Development Code, as amended hereby, which shall remain in full force and effect. SECTIONS. An offense committed before the effective date of this Ordinance is governed by prior law and the provisions of the Allen Land Development Code Zoning Regulations, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 6. Any person, frim or corporation violating any of the provisions or terms of this Ordinance shall be subject to the same penalty as provided for in Allen Land Development Code Zoning Regulations as previously amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000) for each offense. SECTION 7. This ordinance shall take effect immediately from and after its passage and publication of the caption in accordance with the provisions of the Charter of the City of Allen, and it is accordingly so ordained.
