Min - City Council - 1978 - 05/18 - RegularALLEN CITY COUNCIL !!AA May 18, 1978 Present: Mayor M.B. Pierson Councilmen: Charles Chandler, Joe Former, Glens Andrew, A.C. Brooks, Jr., mad H.R. Daugbtery The minutes were read from the previous meeting with 2 corrections requested. (1) That Walter Damon's reason for overhead utilities, which was that the easement would not be maintained otherwise, was a non -effective may to take care of the problem that supposedly overhead utilities would eliminate. (2) That the motion was Rot 100% underground utilities in Hillside #5, but reasonably close to it, so that if they had some lines laid against the boundaries, and poles already set, that they wouldn't have to drop down and dig ditches for that too. Motion Farmer Second Andrew to adopt minutes with these corrections. Motion carried 5 for 0 against. A letter from Mrs. Margaret Rainford regarding the park discussion from the previous meeting was read by the mayor. She thanked the council for listening to those who spoke, although she knew that the problem had not been completely resolved) however, she did feel that the city did have an interest in providing park facilities for their neighborhood. A letter from P & Z was read concerning their recommendation for the Tomlin Properties preliminary plat for Green Meadows Estate, which is to be developed ///+++ in our extra territorial jurisdiction and were requesting use of our water. The preliminary plat was approved by P & Z, subject ton 100' right of way on Rock Ridge and Exchange Parkway extensions, asphalt paving surface, no curb, bar ditch gutter and subject of the engineers review and approval. A motion was made by P & Z to amend the motion to include a 24' paved county road section on Rock Ridge Rd and Exchange Parkway, 20' on remainder of roads and subject to state approval of roads. A motion was made to amend the roads to meet the county requirements. After much discussion sad study by Jimmy Eaton and Ron Fix, a motion was made by Farmer to grant approval of the 500' spacing of fire plugs, 8" water lines as indicated by Jimmy, 24' streets, Rover easements, but bold on the type of street, this being the same as the recommendation of P & Z, with the exception of 6" lines on the cul de sacs, and also with the addition of a sever moment. Second by H.C. Brooks. Hi Daugherty pointed out that they were granting approval to overhead utilities which has been a current problem.. They stated that there would be overhead in the back, with underground leads to the bouse, which is about 400' from the street. Motion carried unanimously. 1 Planning and Zoning also reco®ended that a request for a special exception 00 for a car wash be allowed on 2170 next to the Sonic. Motion Andrew Second ff�� Chandler to set June 1 as date for public hearing. Motion carried unanimously. A Public Hearing was held to allow a special exception request for a Day Care Center in R32R1 zoning, which is an a acre in on 8 acre tract on Bethany east of Hwy 5 and joins Boyd Elementary an the east and the proposed opts on the vest. Motion Brooks Second Chandler to grant the special exception request. Motion carried 5 For 0 Against. 144 D Allen City Council Regular Session May 18, 1978 Page 2 A Public Hearing was held on property owned by Allen properties, of which the mayor has a financial interest and excused himself to tura the meeting over to Tee Farmer, Mayor ProTem. The request on 17 acres is the Rufus Sewell Suave, Abstract #875 was to rezone from THPD to G.B. Motion by Brooks to great request. Second by Chandler. The vote was 2 for (Brooks and Chandler) and 2 opposed (Andrew and Daugherty), with Farmer Making the tie breaking vote for the request as there was no use at the council meeting to oppose the rezoning. � I- -� Mr. Richardson, Building Inspector, had presented some amendments to our codes at the previous meeting , which he would like to have approved, and they are as follows: (1) Smoke detectors in all new construction (2) 3 way light switches in the hall (3) Disconnect switch on outside electric meter. (4) Insulation on hot water pipes, from hot water beater to each bath and kitchen. Item #1 - Motion Brooks to table for more input from Fire Dept. Second Farmer. Motion carried 5 For 0 Against. #2 - Motion Daugherty to revert back to information of our codes if we have to, which requires it on a 10' hall. Second Brooks. Motion carried 5 For 0 Against. #3 - Motion Daugherty to adopt outside disconnect switch. Second Andrew. 4 for 1 (Brooks) abstaining. #4 - Motion Brooks to table until next meeting for research. Motion died for lack of second. After more discussion a motion was made by Andrew to tablein order to determine the cost factor. Second Chandler Motion carried 4 for 1 against. City to secure 60' working easement and 15' permanent easement from property Owners. Bob Overby of 808 Thoreau requested that he be allowed to construct a building or ewer over his pool. He was advised to go tb%the utility companies and get a written approval from them that this will not isterfer with their easements. Motion Brooke Second Chandler that when he brings these written croseata, Mr. Richardson is authorized to issue his permit. Motion carried 5 for 0 against. Sam Wyse requested a 7.00 P.M. Executive Session m June 1 to present his draft for proposed sub division ordinance. The council adopted an ordinance to extend for 30 days TP & L's rate increase request.
