' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, APPROVING A LICENSE AGREEMENT WITH THE DALLAS
AREA RAPID TRANSIT (DART) FOR THE INSTALLATION OF ONE S -INCH
WATER LINE ACROSS DART RIGHT-OF-WAY IN ASSOCIATION WITH THE
VILLAGE DRIVE CAPITAL PROJECT; AUTHORIZING THE CITY MANAGER
TO EXECUTE THE LICENSE AGREEMENT; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, DART owns the railroad tracks that parallel US 75 and bisect the City of Allen; and,
WHEREAS, DART requires a formal license of any crossing or use of its right-of-way (ROW); and,
WHEREAS, the Village Drive Capital Project requires the installation of paving one 8 -inch water line across
the DART ROW.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The License Agreement by and between the City of Allen, Texas, and DART are hereby
approved, and the City Manager is authorized to execute the License Agreement on behalf of the City.
' SECTION 2, This Resolution shall become effective from and after its passage.
DULY PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, ON THIS THE 12TH DAY OF FEBRUARY, 2005.
