R-2610-3-07RESOLUTION NO. 2610-3-07(R) A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, OPPOSING THE PROPOSED CRAIG RANCH TRANSMISSION LINE PROJECT BY BRAZOS ELECTRIC POWER COOPERATIVE, INC. REGARDING THEIR PROPOSED ROUTES IN THE NORTHERN PART OF ALLEN ALONG THE 121 CORRIDOR; MAKING FINDINGS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Brazos Electric Power Cooperative, Inc. ("BEPC") is proposing to construct approximately two miles of double circuit 138 kV transmission line with single -pole concrete/smel structures from CoSery Electric's proposed Craig Ranch Substation, located in the City of McKinney to a tap point along TXU Electric Delivery's existing North Allen/McKinney, TXU transmission line; and, WHEREAS, CoSery Electric, a member of BEPC, has determined there is a need for a transmission line to connect their proposed Craig Ranch substation located in McKinney to the existing North Allen/McKinney, TXU transmission line; and, WHEREAS, BEPC held a public meeting on March 15, 2007, to announce the proposed location of the Craig Ranch Transmission Line Project and proposed seven alternate routes. Two of the alternate routes, labeled as route C and route G on BEPC's maps, are located in the Allen city limits and a portion of a third alternate route, labeled as route A, has a portion within the Allen City limit; and, ' WHEREAS, the City of Allen, Collin County, Texas ("City") has three different electric wire line providers including Denton County Electric Cooperative, Inc., d/b/a CoSery Electric ("CoServ"), Gmyson-Collin County Electric Cooperative ("GCEC"), and TXU Electric Delivery ("TXU") that are certified by the Texas Public Utility Commission to provide service in Allen as displayed in Exhibit A; and, WHEREAS, because there are three certified electric wire line providers in Allen, the majority of the City has dual electric certification and a small portion even has triple certification to provide electricity. The proposed routes by BEPC in Allen are in an area which has both dual and triple certification indicating a compelling reason that the proposed transmission line is not necessary for providing electric service to Allen because there are alternative power sources available; and, WHEREAS, BEPC's proposed alternative routes in Allen are along the State Highway 121 corridor that the City Council has planned and zoned as an entertainment/retail destination with a tremendous economic impact for the city and is currently under development as displayed in Exhibit B; and, WHEREAS, the Arts of Collin County, owned by the cities of Allen, Plano and Frisco, is locating a $100 million performing arts facility in close proximity to the southwest of the proposed transmission line project along the SH 121 corridor; and, WHEREAS, the City of Allen understands the importance of providing low-cost, reliable electricity service while balancing the challenge of finding an ideal location for such facilities, but the City of Allen believes that BEPC and CoSery Electric have not exhausted all thew resources in finding the best and most cost effective approach to providing electric capacity to McKinney's Craig Ranch development; and, ' WHEREAS, the City of Allen showed our understanding of the importance of planning for utilities for future growth by hosting meetings with CoSery Electric on November 29, 2006, and TXU Electric Delivery on February 12, 2007, to discuss capacity planning and how it relates to the City's development plans. During these meetings a general discussion took place regarding the location of a sub -station within the general McKinney/Allen area, where both companies indicated a priority is to co -locate their substations to minimize t costs and the impact to the community. During the November meeting, CoSery did not indicate that a transmission line would be proposed in Allen. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The City of Allen is opposed to locating any portion of the Craig Ranch Transmission Line Project within the City of Allen boundaries because there are two and three certified electric wire line providers within the same geographic boundary as the proposed alternative routes are located. SECTION 2. The City of Allen strongly encourages BEPC and CoSery Electric to carefully study alternative options related to whether or not a transmission line is really necessary. Such study should include an option of relocating the proposed Craig Ranch substation to a point closer to the existing TXU North Allen/McKmney transmission line. This would minimize or eliminate the need for an expensive transmission line since the point of entry into the power source, or the North Allen/McKinney transmission line, can be located at any point along the line. SECTION 3. The City of Allen believes BEPC and CoSery should fiuther study the cost/benefit of locating a substation directly below the existing transmission line to eliminate the need completely for a transmission line, and resulting in less costly distribution lines being constructed to deliver power to the end point. Such study should consider co -locating a substation with the other area electric providers. SECTION 4. If the relocation of the sub -station is not possible and since this area in Allen is a dual and triple certified area between CoServ, GCEC, and TXU Electric, the City of Allen believes the majority of the t immediate need for the transmission line is for CoSery to serve McKinney's Craig Ranch development, then the proposed transmission line should be placed to the north of SH 121. SECTION 5. A copy of this Resolution shall be sent to Brazos Electric Cooperative, hic, care of Richard Chambers, at 2404 LaSalle Avenue, Waw, Texas 76712, and to CoSery Electric, care of Curtis Trivitt, at 7701 South Summons, Corinth, Texas 76210-1842. SECTION 6. This resolution shall take effect from and after its passage.
