' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN
COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING
CHAPTER 14, "UTILITIES" TO AMEND WATER AND SEWER RATES;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN,
COLLIN COUNTY, TEXAS, THAT:
SECTION 1. The Code of Ordinances of the City of Allen, Collin County, Texas, be and the same is
hereby amended by amending Chapter 14, "Utilities", Section 14-6 "Sanitary sewer charges," in part, to add
subsection (6) to read as follows:
"CHAPTER 14
ARTICLE L IN GENERAL
Sec. 14-6. Sanitary sewer charges
(6) Out of City Sewer Customers that are Also Out of City Water Customers. The provision
' of sewer service to customers outside the City limits is at the discretion of the City Engineer
and any extension of service will have the approval of the North Texas Municipal Water
District. Commercial and residential customers that are outside the City limits that are
approved to receive sewer service that are also City water customers at the same service
address shall be billed for sanitary sewer service monthly based on their total volume of water
consumption as follows: the monthly in -City minimum charge and the in -City volumetric
charges for thew rate class (residential, commereiallapartments, municipal/school) plus a
premium on the prevailing monthly minimum charge and volumetric rate of twenty-five (25)
percent. As the City's water and sewer rates are increased, so shall the calculation of the
twenty-five (25) percent rate premium."
SECTION 2. All ordinances of the City of Allen, Collin County, Texas, in conflict with the provisions of
this ordinance be, and the same are hereby, repeated; provided, however that all other provisions of said
ordinances not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 3. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this
ordinance, m amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect
the validity of the remaining portions of said ordinance, which shall remain in full force and effect.
SECTION 4. An offense committed before the effective date of this ordinance is governed by prior law and
the Code of Ordinances of the City of Allen, as previously amended, in effect when the offense was
committed and the former law is continued in effect for this purpose.
SECTION 5. This ordinance shall take effect immediately from and after its passage and publication in
' accordance with its provisions of the Charter of the City of Allen, and it is accordingly so ordained.
