O-107-5-71ORDINANCE N0, 107 AN ORDINANCE AMENDING THE GENERAL ZONING ORDINANCE OF THE CITY OF ALLEN SO THAT A PART OF ZONE "A" IS REZONED AND PLACED IN ZONE "F"; DESCRIBING THE TRACTS TO BE REZONED; PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; AN EFFECTIVE DATE OF THIS ORDINANCE; THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City Council of the City of Allen, Texas, is charged with the responsibility of providing for the public health, safety and welfare of the people of the City of Allen, and WHEREFORE, zoning according to tracts offers a reasonable method for a city to provide control over subdivision of land within its boundaries, and WHEREAS, the below described property has been lawfully incorporated into the City of Allen, Texas, and WHEREAS, the legal notices required for zoning have been given in the manner and form set forth by law, and a public hearing has been held on the proposed zoning classifi- cation, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Allen, Texas: SECTION I: That the following described property, to -wit: TRACT I: SITUATED in the City of Allen, Collin County, Texas, and being all of Lot 6 and Lot 7 in Block 20 of the Old Donation to the Town of Allen, according to the map recorded in Volume 6, Page 152, Collin County Deed Records. TRACT II: SITUATED in the City of Allen, Collin County, Texas, and being all of Lot 8, Lot 9, and Lot 10 in Block 19 of the Old Donation to the Town of Allen, according to the map recorded in Volume 6, Page 152, Collin County Deed Records. is hereby rezoned from its present Zone "A" to Zone "F" according to the uses allowed by Zone "F" in the General Zoning Ordinance of the Town of Allen. SECTION II: It shall be unlawful for any person, firm or corporation to make use of said premises in some manner other than is authorized by this Ordinance. SECTION III: Any person, firm or corporation who violates any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction therefor, shall be fined any sum not exceeding $200.00, and each and every day that such violation continues shall be considered a separate offense; provided, however that such penal provision shall not preclude a suit to enjoin such violation. SECTION IV: The Caption of this Ordinance shall be published one time in a weekly newspaper published in the City of Allen and shall be effective immediately upon its passage and such publication.
