O-102-3-71CITY OF ALLEN, TEXAS, ORDINANCE N0. 102 AN ORDINANCE REGULATING NOISE AND SMOKE FROM MOTOR VEHICLES; PROHIBITING THE OPERATION OF A MOTOR VEHICLE IN SUCH A MANNER SO AS TO CREATE EXCESSIVE NOISE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE PUBLICATION OF THE CAPTION OF THIS ORDINANCE AND AN EFFECTIVE DATE HEREOF. WHEREAS, THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, is charged with the responsibility of providing for the public health, safety and welfare of the citizens of the community, and WHEREAS, the operation or running of a motor vehicle creating excessive, loud or unusual noise or smoke is hereby declared to be a public nuisance. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION I. That from and after the effective date of this Ordinance, it shall be unlawful for any person to run or operate a motor vehicle inside the corporate limits of the City of Allen, Texas, which creates loud, unusual or excessive noise, or which results in the production of unusual or annoying smoke. SECTION II. That from and after the effective date of this ordinance, it shall be unlawful for the driver of an automobile to operate his vehicle in such a manner as to cause the tires on his vehicle to make loud, unusual or excessive noise and it shall further be unlawful for the operator of an automobile to operate the motor on said automobile in a manner which creates loud, excessive or unusual noise. SECTION III. That any Ordinance in conflict with the provisions hereof is expressly repealed. SECTION IV. Any person violating this Ordinance shall be fined not more than two hundred ($200.00) Dollars for each offense. Each time that a violation occurs shall constitute a separate offense. SECTION V. The caption of this Ordinance shall be published one (1) time in a weekly newspaper having general circulation in the City of Allen, Texas, and said Ordinance will be effective immediately after its adoption and pub- lication.
