Min - City Council - 1980 - 03/20 - RegularREGULAR SESSION Allen City Council March 20, 1980 Present; Mayor M.B. Pierson Councilmen: Joe Farmer, Rex Womack, Charles Chandler and Richard Chumbley Absent: H.R. Daugherty and Glenn Andrew The meeting was called to order by Mayor M.B. Pierson. Motion Chumbley Second Chandler to approve the minutes of the March 61 1980 meeting. Motion carried 5 for 0 against. A Public Hearing was held on a request for a special exception to operate a plant nursery in a local retail zone by Gary Taylor and Eddie Brister. Motion Chandler Second Farmer to grant a special exception to operate a specific business (Greenhouse and Plant Nursery) in a Local Retail Zone. Motion carried 5 for 0 against. A request was made by C.A. Richards for a Special Exception for a Day Care Center in a General Business Zoning. Motion Farmer Second Chumbley to set a Public Hearing for April 3, 1980. Motion carried 5 for 0 against. The sign variance request from Goodman Homes that was tabled last council meeting, March 6, until Bill Petty, Building Official had made a survey of signs throughout the city, was brought before the council again. Motion Farmer Second Chumbley to grant the variance request for 1 year from the time the permit is issued. Motion carried 4 for 1 against. (Charles Chandler) Bill Petty was advised by Mayor Pierson to proceed with certified letters to sign owners who are in violation. Mr. Petty stated that he had already contacted some of the owners and they indicated to him that they would comply with either getting a permit or taking their sign down. The preliminary and final plats of Timber Bend were presented to the council by Reese Brown. The mayor read a portion of a letter from Fox and Jacobs in regard to their tendering a check for the Park Dedication in the amount of $22,800, which they would be making "under protest". Several residents in that area voiced their disapproval of the plats because of the open drainage and the abundance of Today homes. Motion Farmer to approve the plat as presented. Motion died for lack of a second. Motion Chandler to replat and make lot sizes 7500'. Motion died for lack of a second. Motion #3 by Chumbley to table. Second Farmer. Motion carried 5 for 0 against. After a short break the meeting resumed with a motion by Farmer Second Chumbley to bring Timberbend plats back before the council. Motion carried 3 for 1 against.(Chandler) Womack had to leave the meeting. Motion #5 by Farmer Second Chandler to deny the request until the council received clarification of the letter and some acceptable plans to resolve the drainage problem. Motion carried 4 for 0 against. Bob Acker, Civil Defense Director, came before the council seeking authorization to use local funds to purchase emergency generators and 3 monitors. Motion Farmer Second Chandler to authorize this request to use local funds in the amount of $11,419.50 for emergency generators and monitors. Motion carried 4 for 0 against. 12- Motion Y Motion Chumbley Second Farmer to authorize the expenditure of $3510 for items #3 and 5 of the redevelopment plan for Hillside Park (out of the donation from Mrs. Eugene McDermott); items #1 and 2 - $9174.50 from 1979 G.O. Bond funds, and that items #4 and 6 be brought back with new cost estimates and an update on the park appropriations in the bond fund. Motion carried 4 for 0 against. No action was taken on the Library study outline. Motion Chumbley Second Farmer to approve Planning and Zoning By -Laws. Motion carried 4 for 0 against. Motion Chandler Second Chumbley to approve payment of bills from bond funds as follows: Inter�en r Sal Aerial Mapping $6175.00, A.E. Group $2000.00 Aerial Mapping' and Gene Geer, Engineer, for Bethany Rd. $360.00 (1979 G.O. Bond Funds). Motion carried 4 for 0 against. The council authorized the City Secretary to order Election ballots as follows: Absentee - numbered 1-25 and regular ballots 1 - 2500, for the April 5th election.
