O-128-5-72ORDINANCE NO. ]28 ORDINANCE PRESCRIBING RATES AND CHARGES OF THE WATERWORKS AND SANITARY SEWER SYSTEM OF THE CITY OF ALLEN, TEXAS THE STATE OF TEXAS X X COUNTY OF COLLIN X X CITY OF ALLEN X ON THIS, the 4th day of May, 1972, the City Council of the City of Allen, Texas, convened in regular session at the regular meeting place thereof in the City Hall, the meeting being open to the public and notice of said meeting, giving the date, place and subject thereof, having been posted as prescribed by Article 6252-17, Section 3A, V.A.T.C.S., there being present and in attendance the following members, to wit: FRANK DUGGER MAYOR ROBERT LOWMAN - ) C. D. WHITAKER ) CLIFFORD HART ) ALDERMEN JOHNNY PANNELL ) JOHNNY BLANKENSHIP ) and with the following absent; constituting a quorum; and among -other proceedings had were the following: The Mayor introduced a proposed ordinance. The ordi- nance was read in full. Alderman made a motion that any rule requiring ordinances to be read more than one time or at more than onat ng be suspended. The motion was seconded by Alderman and carried by the following vote: AYES: Aldermen Lowman, Whitaker, Hart, Pannell and Blankenship. NOES: None. Alderman�� then made a motion that the ord' ance be passe finally. The motion was seconded by Alderman and carried by the following vote: AYES: Aldermen Lowman, Whitaker, Hart, Pannell and Blankenship. NOES: None. The Mayor announced that the ordinance had been finally passed. The ORDINANCE is as follows: fI AN ORDINANCE by the City Council of the City of Allen, Texas, prescribing the rates to be charged for services furnished by the Waterworks and Sanitary Sewer System awned and operated by said City; repealing all ordinances, orders or resolutions in con- flict herewith; and declaring an emergency. WHEREAS, this City Council has determined that it is necessary and to the best interest of the City and its inhabitants to provide a schedule of rates or charges to be made for the ser- vices furnished by the City's combined Waterworks and Sanitary Sewer System; therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: That the monthly rates or charges for ser- vices furnished by the Waterworks and Sanitary Sewer System of said City shall be as follows: WATER RATES: (MONTHLY BILLING) Residential First 1,500 gallons $3.00 (minimum) Next 8,500 gallons .95/M gallons Next 10,000 gallons .50/M gallons Next 10,000 gallons .35/M gallons Over 30,000 gallons .25/M gallons Commercial First 1,500M gallons $3.00 (minimum) Next 9,500M gallons .95/M gallons Next 10,000M gallons .50/M gallons Next 20,000M gallons .35/M gallons SEWER RATES: (MONTHLY BILLING) Residential and Commercial $3.00 flat rate Service Stations and Washaterias 6.00 flat rate SECTION 2: That such rates and charges hereby fixed and prescribed shall be paid by the customers of the Waterworks and Sanitary Sewer System to the City Secretary of the City of Allen, Texas, in advance of the 10th day of each month, and which shall be the date such rates or charges shall become due and payable; and in case any user or customer of such System does not pay the amount due by such user or customer within fifteen (15) days from the date the same becomes due and payable, then it is hereby made the duty of the City Secretary to add a ten percent (10%) ,penalty to the amount past due and unpaid. SECTION 3: The City shall simultaneously collect the respective amounts due the City for services supplied by the Waterworks and Sanitary Sewer System, and shall refuse to accept payment for a part of such service, unless the entire amount due from such respective customer for all services supplied by such Waterworks and Sanitary Sewer System is paid. SECTION 4: In the event any user or customer of such Waterworks and Sanitary Sewer System does not pay matured rates and charges within thirty (30) days from the date the same become due and payable, it is hereby made the further duty of the City Secretary to disconnect services so supplied, and whenever the amount past due and delinquent is paid by such user or customer, such service may be resumed, but there shall be charged and collec- ted a $ fee for reconnection to the Waterworks System. The reconnection charge for sewer services shall be not less than the actual cost to the City for disconnecting and reconnecting sewer service. SECTION 5: That no free service shall be allowed, and to the extent the City or any of its agencies or instrumentali- ties avail themselves of the services and facilities provided by the Waterworks and Sanitary Sewer System, they shall pay therefor the same rates and charges herein prescribed. SECTION 6: The tapping fee applicable to users of the City's Waterworks and Sanitary Sewer System shall be not less than the actual cost to the City. No dual connections (being more than one user on a single line) shall be permitted. SECTION 7: The Waterworks System shall be operated on a fully metered basis. SECTION 8: This ordinance and the rates and charges herein prescribed shall be in effect from the first billing period after the City begins taking water from the North Texas Municipal Water District. As of the effective date of this ordinance any and all ordinances, resolutions and orders in conflict herewith are repealed to the extent of the conflict. SECTION 9: The fact this ordinance should be adopted at this time to provide an orderly transition in charges for services supplied by the water and sewer system of the City creates an emergency and an urgent public necessity requiring that this ordi- nance be passed and take effect as an emergency measure, and that any rule requiring ordinances to be read more than one time or at more than one meeting be suspended, and any such rule is hereby suspended and this ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage.
