O-123-4-72CITY OF ALLEN, TEXAS, ORDINANCE NO. 123 AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF ALLEN, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID PROPERTY WITHIN THE CITY LIMITS AND GRANTING TO ALL INHABITANTS OF SAID TERRITORY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID INHABITANTS BY ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS OF THE CITY AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, application having been duly made for annexing the below described territory to the City of Allen, Texas, which application is in the form of a petition duly and legally executed and filed with the Mayor of the City of Allen, Texas, and the Mayor, having certified the same to the Council of the City of Allen, Texas, and WHEREAS, a public hearing was held not more than twenty nor less than ten days prior to the institution of such annexation proceedings with notice of such hearing given in the manner prescribed by law and all other requirements of notice and completion of such annexation procedure being fulfilled, and WHEREAS, the Council of the City of Allen, Texas, has investigated into and determined that all of the facts contained in said petition are true, and WHEREAS, the Council of the City of Allen, Texas, has investigated and determined that it will be advantageous and beneficial to the City of Allen, Texas, and its inhabitants as well as the hereinafter described territory to annex such territory to the City of Allen, Texas, and WHEREAS, the Ordinance originally annexing the hereinafter described territory dated October 14, 1954, has been misplaced and it is necessary to enact a new Ordinance; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALLEN, TEXAS: SECTION 1: That the territory described as follows be and the same is hereby annexed to the City of Allen, Texas, to -wit: SITUATED in Collin County, Texas, and being all the property known as the E. B. Young Addition to the City of Allen, the plat of which addition is recorded in Volume 2, Page 51 Plat Records Collin County, Texas. SECTION 2: That from and after October 14, 1954, said territory shall be a part of the City of Allen, Texas, and the inhabitants thereof shall be entitled to all of the rights, privileges and immunities of all other citizens of the City of Allen, Texas, and shall be bound by all of the ordinances and regulations enacted pursuant to and in conformity with the general laws of the State of Texas. SECTION 3: This ordinance shall take effect and be retroactive to October 14, 1954, upon its passage and approval and it is so ordained.
