CITY OF ALLEN, TEXAS, ORDINANCE NO. 133
AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF
ALLEN, TEXAS, AND EXTENDING THE BOUNDARY LIMITS
OF SAID CITY SO AS TO INCLUDE SAID PROPERTY WITHIN
SAID CITY LIMITS AND GRANTING TO ALL THE INHABITANTS
OF SAID TERRITORY ALL THE RIGHTS AND PRIVILEGES OF
OTHER CITIZENS AND BINDING SAID INHABITANTS BY 4.L
OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS
OF SAID CITY, AND PROVIDING FOR AN EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, application having been duly made for
annexing said territory to the City of Allen, Texas, which
application is in the form of a petition duly and legally
executed and filed with the Mayor of the City of Allen,
Texas, and the Mayor, having certified the same to the
Council of the City of Allen, Texas, and
WHEREAS,
the
Council of the
City
of Allen
has
investigated
into
and determined
that
all of the
facts
contained in said petition are true, and
WHEREAS, a public hearing was held not more than
twenty nor less than ten days prior to the institution
of such annexation proceedings with notice of such hearing
given in the manner prescribed by law and all other
requirements of notice and completion of such annexation
procedure being fulfilled, and
WHEREAS, the Council of the City of Allen has
investigated and determined that it will be advantageous
and beneficial to the City of Allen and its inhabitants
as well as the hereinafter described territory to annex
such territory to the City of Allen, Texas;
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF ALLEN, TEXAS:
SECTION 1: That the territory described as follows
be and the same is hereby annexed to the City of Alen,
Texas, to -wit:

SITUATED in Collin County, Texas, and being out of the
R. L. Ingraham Survey, Abstract No. 462 and the R. C.
Whisenant Survey, Abstract No. 1012 and being a part of a
104.00 acre tract and a 50.00 acre tract out of said surveys
as described in a deed dated June 25, 1954, in the name of
Albert Smith and wife, Eula Smith, and recorded in Vol. 486,
Page 361 of the Collin County Deed Records, and being
described more particularly as follows:
BEGINNING at a point in the East boundary line of the
City of Allen, Corporate Limits, said point also being the
center line of Jupiter Road;
THENCE in an Easterly direction along the Center Line
of an unnamed County Road 1759.56 feet to a point;
THENCE N. 88 deg. 35 min. East along the said public
road at 848.51 feet, leave road, in all 944.51 feet to an
iron stake for co-rner in the common line of the said R. L.
Ingraham and R. C. Whisenant Surveys;
THENCE NORTH along said survey line, 64.78 feet to an
iron stake for corner in same at its intersection with the _
center line of said public road;
THENCE in a northeasterly direction along the center
line of said road as follows: N. 55 deg. 00 1 E, 68.10 feet
and No. 89 deg. 281 E, 911.25 feet to an iron stake for
corner therein;
THENCE NORTH, 2246.78 feet to an iron stake for corner
in an established fence line on the north line of said Smith
104.00 acre tract;
THENCE NORTH 89 deg. 581 West along an established fence
line on the north lines of said Smith 104.00 acre tract and
the said 50.00 acre tract at 967.0 feet the northeast corner
of said 50.00 acre tract and the northwest corner of said
104.00 acres in the common line of said Ingraham and Whisenant
Surveys, in all on this line, 1859.23 feet to the northwest
corner of said 50.00 acre tract, an iron stake for corner in
the West line of said R. L. Ingraham Survey;
THENCE SOUTH 1 deg. 14' W. along said survey line 2383.25
feet to a point for corner;
THENCE in a westerly direction along the North right-of-
way line of a public road 1759.56 feet to a point in the
center line of Jupiter Road, said point also being in the East
Boundary line of the Corporate Limits of the City of Allen and
containing 100.00 acres of land and being 50.00 acres in the
R. L. Ingraham Survey and 50.00 acres in the R. C. Whisenant
Survey.
SECTION 2: That from and after the passage of this
Ordinance, said Territoryshall be a part of the City of
Allen, Texas.
SECTION 3: This Ordinance shall take effect
immediately upon its passage and approval and it is
so ordained.
