AN ORDINANCE REQUIRING CONCRETE STREETS AND ALLEYS
IN ALL SUBDIVISION TO THE CITY OF ALLEN, TEXAS;
PROVIDING FOR PRIOR I14SPECTION AND APPROVAL; PROVIDING
y FOR A PENALTY FOR A VIOLATION OF THIS ORDINANCE; PRO-
VIDING A SAVINGS CLAUSE; PROVIDING FOR THE PUBLICATION
OF THE CAPTION HEREOF AND AN EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ALLEN, TEXAS:
SECTION I - That from and after the effective date of
this Ordinance, in all future Subdivisions to the City of
- Allan, Texas, concrete streets and alleys shall be required.
SECTION II - That the Subdivision Developer shall submit
to the City of Allen by preliminary plat, plans and
specifications in writing for such streets and allays, prior
to any construction and such plans and specifications shall
�e be subject to approval by the designated City Agent, prior
to any such construction.
SECTION III - That the Subdivision Developer upon
completion of such streets and alleys shall submit in
writing a warranty to the City of Allen warranting such
streets and alleys to be of good workmanship and repair
and free from construction defects for a period of
12 Months
SECTION IV - It shall be unlawful for any person,
firm or corporation to construct such streets and alleys
in any manner other than is authorized by this Ordinance.

SECTION V - Any person who is found to be guilty of
the violation of a provision of this Ordinance shall be
guilty of a misdemeanor and upon conviction shall be fined
Je aum not to exceed $200.00, and each and every day such
violation continues shall be considered a separate offense;
provided, however, that such penal provision shall not
preclude a suit to enjoin such violation.
SECTION VI - That should any part or portion of this
Ordinance be declared unconstitutional by a Court of
competent jurisdiction, it is expressly provided that
the remaining portion of this Ordinance shall remain in
full force and effect.
SECTION VII - The caption of this Ordinance shall be
Published one (1) time in a weekly newspaper having general
Publication in the City of Allen, Texas, and said Ordinance
shall be effective Sam, diately upon its adoption and
Publication and it is so ordered.
