O-2406-5-05ORDINANCE NO. 2406-5-05 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 6, "HEALTH AND ENVIRONMENT," BY ADDING SECTION 6-66 "COMPOSTING PROGRAM"; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABIIdTY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, THAT: SECTION 1. The Code of Ordinances of the City of Allen, Texas, be and the same is hereby amended by amending Chapter 6, "Health and Environment," by adding Section 6-66 "Composting Program" to read as follows: "Sec. 6-66. Composting Program. The City provides free composting material for private residential use by Allen residents limited to three (3) cubic yards of composting material per residence per calendar month. Residents may obtain composting material at the times and at one or more locations designated by the Community Services Director, or designee, upon presentation of a current City utility bill, Texas driver's license, identification ' card, or other satisfactory proof verifying Allen residence." SECTION 2. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 3. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 4. Any person, firm or corporation violating any of the provisions of this Ordinance or of the Code of Ordinances, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of Allen, Texas, shall be subject to a fine not to exceed the sum of Two Thousand Dollars ($2,000) for each offense, and each and every day said violation is continued shall constitute a separate offense. SECTION 5.
