Min - City Council - 1980 - 10/16 - Regular0 REGULAR SESSION Allen City Council October 16, 1980 Present: Mayor M.B. Pierson Councilmen: Rex Womack, Glenn Andrew, Joe Farmer, H.R. Daugherty, Jim McClure, and Richard Chumbley Absent: None The meeting of the Allen City Council was called to order by Mayor M.B. Pierson. Motion Womack Second Chumbley to approve the minutes of the regular meeting of the Allen City Council held on the 2nd day of October, 1980. The motion carried 7 for 0 against. Motion Daugherty Second Andrew to set a Public Hearing for November 6, on a request by Ron Crockett for site plan approval to develop and construct mini warehouses on 2.658 acres in the M.See Survey, Tract 4D, Abstract 543 and zoned OC -PD. Motion carried 7 for 0 against. Motion Daugherty Second Andrew to set a Public Hearing for November 6 on a request from Carl Gilliland for a variance to off street parking requirements on lots 1-2A-9, Block 17, Old Donation. Motion carried 7 for 0 against. Motion Womack Second Daughery to adopt annexation ordinance #320, AN ORDINANCE OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, ANNEXING THE HEREINAFTER -DESCRIBED TERRITORY TO THE CITY OF ALLEN, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF THE CITY SO AS TO INCLUDE SAID HEREINAFTER -DESCRIBED PROPERTY WITHIN THE CITY LIMITS AND GRANTING TO ALL INHABITANTS AND OWNERS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY ALL THE ORDINANCES, ACTS, RESOLUTIONS AND REGULATIONS OF SAID CITY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF SAID ORDINANCE. Motion carried 7 for 0 against. Mr. Pat Vick of Vick's Trucking appeared to request an exten- sion of his special exception use allowed by the council 18 months ago, which allowed him to use a mobile home for a place of residence for a security guard. Motion McClure Second Andrew to deny this request and that the trailer be allowed to remain on the property until midnight December 31, 1980, at which time it is to be removed. Motion carried 6 for 0 abstaining. (Chumbley abstaining from discussion and vote because of a conflict of interest). ykl J.W. Reed, presented for approval the preliminapy plat of Bethany Park Apartments, Phase II. Planning and Zoning had recommended approval for the re -subdivision of Bethnay Park, with the allowance of a variance to the subdivision ordinance, which requires alleys in residential areas, and with the developers being required to pay their proportionate share of pro rata (based on acreage ownership) for the future paving of Bethany Road frontage. The developers had agreed to the park dedication in the amount of 43600. Motion Farmer Second McClure to approve the recommendations of Planning and Zoning, which included the pro rata share of Bethany paving, based on the calculations involving lots 3 a 4 only. Motion carried 5 for 2 against. (Andrew and Chumbley) Bob Gass of Fox and Jacobs presented the preliminary and final plat of Timberbend II. Planning and Zoning had recommended approval of this plat, with variances to the Sub Division ordinance requirements for side yard building lines, allowing 15' rather than 251set back requirements. This variance would affect 11 lots along Allen Heights. Park Dedication in the amount of $26,900 was paid September 24, 1980. Motion Chumbley Second Womack to approve the preliminary and final plat and variances as recommended. Motion carried 6 for 0 against. (Andrew). Maribelle Davis, the consultant selected to do the library facilities planning study, was present to review the completed study. The { council will now decide which type system or facility they feel is needed for the City. Motion Farmer Second Daugherty to accept Mrs. Davis study and express their appreciation to her. Motion carried 7 for 0 against. Motion Womack Second Andrew to rescind ordinance #313, which restricted water use except during specified times. Motion carried 7 for 0 against. Bids were received from 3 companies for new library shelving: 1. Business and Institutional Interiors of Dallas $12,133.22 2. Barnhill Office Equipment, Abilene 13,002:98 3. Library Bureau, Houston 12,558.13 Motion Daugherty Second Chumbley to adoptoption C, award bid to Business and Institutional Interiors, and authorize the auctioning of existing shelving. Motion carried 7 for 0 against. Motion Farmer Second Daugherty to approve payment of the CIP bills: American Soils Limited 1640.00 1979 G.O. Bonds Trade Construction Co. 6581.00 " Uvalde Construction (Final) 11566.72 " Motion carried 7 for 0 against. The final tax report for the 1979-80 year was given by the Tax Assessor, �^ with his report showing 98.23% taxes collected for the year. Motion Daugherty Second Andrew to adjourn.
