Call to Order and Announce a Ouorum is Present With a quorum of the Councilmembers present, the Regular Meeting of the Allen City Council was called to order by Mayor Terrell at 7:03 p.m. on Tuesday, August 23, 2016, in the Council Chambers of the Allen City ' Hall, 305 Century Parkway, Allen, Texas. Pledge of Allegiance Public Recognition ALLEN CITY COUNCIL REGULAR MEETING AUGUST 23, 2016 1. Citizens' Comments. MOTION: Upon a motion made by Councilmember Obenneyer and a second by Councilmember Brooks, the Council voted six (6) for and none (0) opposed to adopt all items on the Consent Agenda as follows: 3. Approve Minutes of the August 9, 2016, Regular City Council Meeting. 4. Adopt an Ordinance Amending Chapter 8 of the Code of Ordinances Adding Sections 8-17, Restricting the Sale of Alcoholic Beverages by Package Liquor Stores to Inside Service Only. ORDINANCE NO. 3414-&16: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF ALLEN, TEXAS, BY ADDING SECTION 8-17 RESTRICTING THE SALE OF ALCOHOLIC BEVERAGES BY PACKAGE LIQUOR STORE TO INSIDE SERVICE ONLY; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS (82,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. 5. Authorize the City Manager to Execute the Purchase of Ballistic Vests, Ballistic Helmets with Face Shields, Peacekeeper Shields, Batons and Accessories from Red The Uniform Tailor in the Amount of $75,441. 6. Award Bid and Authorize the City Manager to Execute a Contract with TB2 Services, Inc., dba Aire Dynamics, in the Amount of $358,529 to Upgrade Energy Management Controls Equipment and Technology at Various City Facilities. 7. Receive the Capital Improvement Program (CIP) Status Reports. 8. Receive the Summary of Property Tax Collections as of duly 2016. The motion carried. 9. Conduct a Public Hearing and Adopt an Ordinance Amending Portions of the Allen Land ' Development Code Relating to Section 6.06.11 "Solar Panels". Conduct a Public Hearing and consider a request to amend the Development Regulations and adopt a Concept Plan and Building Elevations for Lot 2R, Block 1, Allen Station Business Park #2, commonly known as 1379 Andrews Parkway; generally located north of Exchange Parkway and west of Andrews Parkway, and within the Planned Development PD -58 Light Industrial LI zoning district. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ORDINANCE NO. 3416-8-16: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALLEN, COLLIN COUNTY, TEXAS, AMENDING THE ALLEN LAND DEVELOPMENT CODE AND ZONING MAP, AS PREVIOUSLY AMENDED, BY AMENDING THE DEVELOPMENT REGULATIONS, ADOPTING A CONCEPT PLAN, AND ADOPTING BUILDING ELEVATIONS FOR LOT 2R, BLOCK 1, ALLEN STATION BUSINESS PARK #2 (COMMONLY KNOWN AS 1379 ANDREWS PARKWAY), CITY OF ALLEN, COLLIN COUNTY, TEXAS, WHICH PROPERTY IS LOCATED IN AND SUBJECT TO THE REGULATIONS OF PLANNED DEVELOPMENT NO. 58; PROVIDING FOR A CONFLICTS RESOLUTION CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. The motion carred. It. Conduct a Public Hearing on the Fiscal Year 2016-2017 Budget as Required by Article IV, Section 4.04 of the Allen City Charter. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. Mayor Terrell announced that the Allen City Council will vote on the FY2017 budget at the September 13, 2016, City Council meeting at 7:00 p.m. at Allen City Hall, 305 Century Parkway, Allen, Texas. 12. Conduct a Public Hearing Regarding the Fiscal Year 2016-2017 City Tax Rate. Mayor Terrell opened the public hearing and asked anyone wishing to speak for or against this item to do so at this time. With no one speaking, Mayor Terrell closed the public hearing. ALLEN CITY COUNCIL REGULAR MEETING AUGUST 23, 2016 PAGES ' MOTION: Upon a motion made by Councilmember Sedlacek and a second by Mayor Pro Tem Caplinger, the Council voted six (6) for and none (0) opposed to set the City Council meeting date of September 13, 2016, at 7:00 p.m. at Allen City Hall, 305 Century Parkway, Allen, Texas, to vote on the proposed tax rate of 52 cents per $100 of the certified appraised value for the Fiscal Year 2016-2017 budget. The Allen Eagles Football Team will play this Friday against Hoover, Alabama. Executive Session The Executive Session was not held.
