Min - City Council - 1981 - 01/15 - RegularREGULAR SESSION ALLEN CITY COUNCIL January 15, 1981 Present: Mayor M.B. Pierson Councilmen: Joe Farmer, Richard Chumbley, Jim McClure, r Rex Womack, Glenn Andrew and H.R. Daugherty Absent: none The regular meeting of the Allen City Council was called to order by Mayor M.B. Pierson. Motion Chumbley Second Womack to approve minutes of the January 8th Special meeting. Motion carried 7 for 0 against. Colleen Hayes came before the council regarding the letter she had previously forwarded to the City which expressed her concern at the lack of school zone information signs within the school zone area between the High School and Rountree Elementary on FM2170. The City Manager informed the council that the State Department of Highways and Public Transportation had been contacted and supplementary signs have already been erected. The State Dept. will also allow the City to install other signs on State right-of-ways at the four streets intersecting 2170; however, Jon requested that no other action be taken at this time, in order to allow time for monitoring the newly erected signs. A Public Hearing on a zoning request from Chuck Forbes was held, with Stan Itzkowitz representing him. Also speaking for this request was Sam Wyse, who made the 1977 Comprehensive Study, Mr. Joe Verdoorn, of Myrick Newman, Dahlberg and Associates, who made the land plan study for Planning and Zoning on that tract and Sam Stolenworck, his attorney. Approximately 10 homeowners spoke against the request. After much discussion concerning the proposed ordinance a motion was made by Chumbley Second by Womack to adopt Ordinance #325, with these amendments a. That on the R-16, 7.56 acre tract; to include the PD designation, to read R-16PD. b. Change section 4, to read that the six (6) months be changed to read twelve (12) months and that the LI be changed to read LI -PD. c. Section 2 (o) to read to include the word visual pollution. Motion Farmer Second McClure to amend the motion to revise the proposed ordinance by adding, (d) that a certificate of Occupancy for Single Famil- Residence Zoning area must be issued on 75% of all the Single Family Zoning Section of the development prior to the issuance of any building permits in the General Industrial (GI -PD) zone. The motion carried on the amendment to motion by 6 for 1 against (Daugherty). Vote was taken on the original motion with amendment (d) included. Motion carried 5 for 2 against (Daugherty and Pierson) to adopt Ord. #325, which included all amendments a,b,c and d, AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, AMENDING THE ZONING ORDINANCE OF THE CITY OF ALLET TEXAS, AS HERETOFORE AMENDED: BY AMENDING THE ZONING DISTRICT CLASS- IFICATIONS OF THE TRACT OF LAND BOUNDED ON THE EAST BY STATE HIGHWAY 5; BOUNDED ON THE WEST BY SOUTHERN PACIFIC RAILROAD; BOUNDED ON THE SOUTH BY BETHANY ROAD; AND BOUNDED ON THE NORTH BY AN EXISTING "R-3" RESIDENTIAL ZONING DISTRICT FROM THE CURRENT ZONING DISTRICT CLASSIFICATIONS OF "R-3", "R -16 -PD" PLANNED DEVELOPMENT ZONING DISTRICTS "GI -PD: AND "LR -PD: AND ZONING DISTRICT "R -16 -PD"; page 2, cont. council meeting 1-15-81 ESTABLISHING DEVELOPMENT STANDARDS FOR PLANNED DEVELOPMENT ZONING DISTRICTS; WITHHOLDING CERTAIN BUILDING PERMITS; PROVIDING A SAVING CLAUSE; PROVIDING INJUNCTIVE RELIEF; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS (200.00); AND PROVIDING AN EFFECTIVE DATE. The motion and amendment to the motion carried complete with all revisions as stated above. The siteplan for the First National Bank was presented by Phil Little. Motion Chumbley Second Womack to approve this site plan. Motion carried 6 for 0 against. (Farmer abstaining) Motion Andrew Second Daugherty to hold public hearings on February 5th on the following requests: 1. Zoning change request on a 7.3 acre tract, from R2 to OC -PD. 2. Request for site plan approval to construct a convenience store. 3. Variance on front building line, lot 10, block 3, High Meadow #2. Motion carried 7 for 0 against on setting date for publichearing Feb. 5. The preliminary and final plat of the First National Bank was also presented by Phil Little. Motion Andrew Second Daugherty to approve as presented. Motion carried 6 for 0 against. 1 abstaining (Farmer) Architects from the firm of Fisher and Spillman, Inc., presented their design of the Fire Substation. Motion Daugherty Second McClure to accept the design of this firm and to authorize them to proceed with the working drawings contingent upon the council receiving the con- struction cost information for brick, tilt up, concrete block and modular. Motion carried 7 for 0 against. Motion Farmer Second Womack to adjourn into Executive Session. Motion carried 7 for 0 against. After reconvening into Regular Session a motion was made by Daugherty Second Chumbley to adopt Resolution #326, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALLEN, TEXAS, AUTHORIZING THE PURCHASE OF 1 ACRE OF LAND FROM MORTON REALTY ASSOCIATES AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS TO EFFECT PURCHASE OF THAT PROPERTY. Motion carried 7 for 0 against. This property is located on Exchange Parkway. Motion Farmer Second McClure to adjourn. Motion carried unanimously.
