ALLEN CITY COUNCIL

Absent : H.R. Daugherty
The regular meeting of the Allen City Council was called to order
by Mayor M.B. Pierson.
Motion Womack Second Farmer to approve the minutes of the February
5 meeting. Motion carried 6 for 0 against.
A Public Hearing was held on a request for Special Exception Use
to construct and locate a subdivision advertising sign in the rear
yard of lot 1, block D, Timberbend I Addition. The request also
included a variance to the height limit. Speaking for Weaver Sign
Company was Wren Carter. After reviewing the request, a motion
was made by Farmer Second McClure to deny the request for a Special
Exception Use to locate a sign. Motion carried 4 for 2 against.

A Public Hearing was held on a request for variance to the length
to
requirement for off street parking spaces, which would reduce size
drainage channel
from the required 20' to 18'. Speaking for this request was Carl
Gilliland. Motion Farmer Second Chumbley to approve the request

to reduce length of off street parking spaces to 18' on lots 1,2A,
9 and 10, of Block 17 Old Donation, which fronts Boyd, Coats and
0 against.
Butler. Motion carried 6 for 0 against.
The Preliminary and Final plats for mini warehouses to be developed
in the J -N Addition were submitted for council approval by Rick
Noble, speaking for Gene Jackson. Motion Chumbley Second Womack to
approve the preliminary and final plat of 3.262 acres out of a
portion of block C, Old Donation, E.B. Reed Survey, Abstract #758.
Motion carried 6 for 0 against.
Buddy Shepard with Norman Luterman presented the preliminary plats of
Fountain Park V,VI and VII. Fountain Park V contains 75 lots,
VI 27 and VII contains 109 lots. Motion Farmer Second Andrew to
approve preliminary plat of Fountain Park V with recommendations from
Planning and Zoning as follows: recommend approval contingent upon
submission of drainage and utility plans being submitted with final
plat which are consistent with the current City of Allen Design
Standards. Motion carried 6 for 0 against. Motion Womack Second
McClure to approve preliminary plat of Fountain Park VI subject to
recommendation of Planning and Zoning (same as for Fountain Park V).
Motion carried 6 for 0 against. Motion Andrew Second Chumbley to
approve preliminary plat of Fountain Park VII subject to Planning
and Zoning contingencies as follows: same as for Fountain Park V and V1
plus the drainage is to be installed underground extending from the
east boundary of Fountain Park VII
to
the
drainage channel
on the
adjacent property. Motion carried

Mr. Gary Atwood, Vice President of Austin Paving Company came before
the council to address the paving problems in Timberbend I, Jupiter
and Bethany Roads. Test results in these areas show that several places
did not meet the minimum specification of the City. Mr. Atwood pres-
ented a proposal in two parts. First, the company agrees to replace
those sections of concrete that do not meet the 3000 pound per square
inch requirement. Second, the company will warrant,equal to 158 of
value of removing and replacing that area, for a 5 year period, those
sections of concrete that were slow to meet the requirements. Motion
Farmer Second Womack to adopt a resolution to accept in principal
the solution as presented by Austin Paving in regards to the question
in Timberbend I and including sections of Bethany Road and Jupiter Road.
Motion carried 5 for 1 against. (McClure)
A plan for unilateral annexation was presented. The City now contains
4139 acres within the corporate limits. In 1980 we could have annexed
108 (413.9 acres), 108 in 1981 (413.9) and a remainder of 18.08 acres
from 1979, for a total of 845.88 acres available for annexation. Planning
and Zoning recommended 3 parcels of land lying on the west side of Hwy 75
totaling 434.547 acres, which would lie in the service area of the sewer
line being laid at the present time. An annexation ordinance was in-
troduced, AN ORDINANCE OF THE CITY OF ALLEN, TEXAS, ANNEXING TO THE CITY
OF ALLEN, TEXAS, A TOTAL OF 434.547 ACRES OF LAND, MORE OR LESS, IN COLLIN
COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO
INCLUDE SAID HEREINAFTER -DESCRIBED PROPERTY WITHIN SAID CITY LIMITS AND
GRANTING TO ALL INHABITANTS AND OWNERS OF SAID PROPERTY ALL OF THE RIGHTS
AND PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY THE ACTS,
ORDINANCES, AND REGULATIONS OF SAID CITY; AND PROVIDING A SEVERABILITY
CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. Motion
Andrew Second Womack to set date for Public Hearing on March 5 on the
following pieces of property, which will be considered for unilateral
annexation:
1. 82.955 acres as described in the Collin County records Volume 606,
page 419, abstract #543 in the Michael See Survey.
2. 31.11 acres described in the Collin County records Volume #891,
page 42, abstract #702 in the L.K. Pegues Survey.
3. 320.482 acres described in the Collin County records, Volume #894,
page 247, abstract #325 in the John Fyke Survey.
Motion carried 6 for 0 against.
An ordinance was presented which would amend Traffic Ordinance #259,
by including the school zone on FM1378 in front of Lovejoy School. Motion
Womack Second Chumbley to adopt Ordinance #329, AN ORDINANCE OF THE CITY
OF ALLEN, TEXAS, AMENDING ARTICLE VI, DIVISION 2, AND SECTION 1-46,
"SPEED IN SCHOOL ZONES; SIGNS IN SCHOOL ZONES:, OF THE ALLEN VEHICLE AND
TRAFFIC CODE, ORDINANCE 259, AS PREVIOUSLY AMENDED BY ORDINANCE NOS.274
AND 309, OF THE CITY OF ALLEN, TEXAS; ALTERING ESTABLISHED ZONES;
ALTERING PRIMA FACIE MAXIMUM SPEED LIMITS ESTABLISHED IN SUCH ZONES
DURING CERTAIN PERIODS ON SCHOOL DAYS; DEFINING SUCH PERIODS AND "SCHOOL
DAYS"; MAKING IT UNLAWFUL TO PASS WITHIN SCHOOL ZONES; PROVIDING PENALTY
CLAUSES, SEVERABILITY CLAUSES AND AN EFFECTIVE DATE. Motion carried for
the adoption 6 for 0 against.

As the need has arisen for a legislative liaison from the City
to provide input to our Legislative Delegation concerning issues
effecting the City, a motion was made by Glenn Andrew and Seconded
by Jim McClure to appoint Richard Chumbley and Joe Farmer as
Liaisons. Motion carried 6 for 0 against.
An annual report of police activity was presented by Chief of
Police, Richard Carroll. He also presented the first of twelve
monthly activity summaries.
Motion Glenn Andrew Second Joe Farmer to adjourn into Executive
Session to discuss personnel and property. Motion carried 6 for
0 against.
Motion Andrew Second McClure to reconvene into regular session.
Motion carried 6 for 0 against.
Motion Andrew Second McClure to authorize Ron Fix to begin
engineering of a 24" water line from McDermott to Bethany, west
of the railroad tracks. Motion carried 6 for 0 against.
Motion Andrew Second Farmer to adjourn. Motion carried unanimously.
